Puerto Rico Proposes Online Casino Regulation to Fund Public Pensions

Puerto Rico's government has introduced a proposal to legalise and regulate online casino gaming, with tax revenues intended to support public-sector pensions. However, traditional casino operators warn that the initiative could threaten jobs and investment.

Puerto Rico is considering a major expansion of its regulated gambling market after Governor Jenniffer González Colón announced legislation aimed at authorising online casino gaming and directing part of the resulting tax revenue towards public-sector pension increases.

The proposal, announced on October 16, 2026, includes administrative measure A158 and House Bill 1514, which would amend the legal framework governing the Puerto Rico Gaming Commission.

The proposed legislation would establish requirements for online casino operators, technology providers and players, alongside measures covering responsible gambling, cybersecurity, consumer protection and the prevention of fraud and money laundering.

It would also introduce a levy on adjusted gross gaming revenue, with proceeds allocated to improving pensions for retired public employees. The government has not yet specified the proposed tax rate or the expected financial contribution to the pension system.

However, the initiative has encountered opposition from the Puerto Rico Hotel and Tourism Association (PRHTA).

The association argues that allowing online versions of traditional casino games could reduce revenues at land-based establishments, affecting employment, infrastructure investment and hotel operations.

Ismael Vega, chairman of the PRHTA Casino Committee, criticised the lack of consultation with existing casino operators before the proposal was introduced. Industry representatives also raised concerns about potential tax advantages for online businesses.

Online sports betting is already permitted in Puerto Rico, but the proposed legislation would represent a further expansion into internet-based casino gaming.

The proposal remains subject to legislative consideration. Its eventual outcome could reshape Puerto Rico's gambling market, creating opportunities for digital operators while raising important questions about competition with established casinos and the sustainability of new public revenue sources.
