Peru Proposes 65% Reduction in Maximum Online Gambling Fines

Peru's Ministry of Foreign Trade and Tourism has proposed reducing the maximum fine for serious online gambling violations from 200 to 70 tax units, while introducing stricter advertising rules and additional compliance requirements for operators.

Peru is considering significant changes to its online gambling regulations, including a 65% reduction in the maximum financial penalties imposed on operators of online gaming and sports betting platforms.

The Ministry of Foreign Trade and Tourism (MINCETUR) published the proposed amendments on October 21 under Ministerial Resolution No. 382-2026-MINCETUR. The changes would modify the regulations implementing Law No. 31557, which governs remote gambling and sports betting.

Under the proposal, maximum penalties for minor violations would decrease from 50 to 11 Tax Units (UIT), while fines for serious offences would fall from 150 to 35 UIT. The maximum penalty for very serious violations would be reduced from 200 to 70 UIT.

The draft also proposes limiting fines to 10% of an operator's annual gross revenue from the previous year, introducing a more proportional approach to enforcement.

However, the reform is not solely focused on reducing penalties. It also introduces stricter obligations concerning gambling advertising, including promotional activities involving influencers, alongside updated requirements for technology providers and unauthorised platforms.

Other provisions address transaction monitoring, technical audits, operating guarantees and regulatory reporting. The proposed changes aim to improve transparency and strengthen consumer protection while making the sanctions system more predictable.

MINCETUR has opened a 15-day public consultation period, allowing operators, industry associations and other interested parties to submit feedback until November 5.

The amendments have not yet been approved. If adopted, they could significantly change compliance costs and enforcement procedures for Peru's regulated gambling industry, combining lower maximum fines with more detailed operational and advertising requirements.
