Kenya Senate postpones voting on Gambling Control Bill 2023

The proceedings of the Kenyan Senate, held on May 16, 2024 and broadcast on YouTube, have once again postponed the vote on the Gambling Control Bill 2023 with amendments, a major piece of legislation aimed at regulating the country's gambling industry.

Originally passed by the National Assembly on December 6, 2023, the bill includes a wide range of measures designed to regulate betting, casinos, and other forms of gambling, including licensing of prize contests, public lotteries, and media advertising.

A key component of the bill is the creation of the Gambling Regulatory Authority of Kenya, which will replace the Betting Control and Licensing Board (BCLB). This new body will oversee the entire gambling sector, enforcing regulations and protecting consumers.

In addition, the bill proposes the establishment of a Gambling Appeals Tribunal to provide a structured dispute resolution process for the gambling industry. It also requires quarterly financial and non-financial reports to be submitted to the National Treasury.

One aspect of the bill is a proposed limit on the number of casinos and slot machines in each of the 47 counties, which would be determined by the cabinet secretary in cooperation with the governor's council. This measure is intended to prevent oversaturation and potential negative social consequences.

The bill also introduces a new minimum capital deposit requirement for gambling operators, set at Ksh 200 million, ten times more than currently.

Other notable provisions include requirements for gamblers to display proof of age,  and penalties ranging from fines up to KSh. 5 million or imprisonment for up to six years for gambling operators found in violation of the law.

Once the bill is still voted on by the Kenyan Senate, it will return to the National Assembly for consideration.
