Chile takes action against unauthorized use of gambling regulator’s image

The Superintendence of Casinos of Chile (SCJ) has issued a public warning after discovering unauthorized use of its institutional logo on social media to promote illegal online gambling platforms. According to the SCJ, these platforms are operating outside the bounds of Chilean law and have not been approved or regulated by the authority.

The regulator reported the matter to the Public Prosecutor's Office, stating that the misuse of its logo and the unauthorized reproduction of images from legally licensed casinos could constitute criminal offenses. The SCJ emphasized that such actions are deceptive, potentially misleading users into believing these platforms are legally sanctioned and overseen by the agency.

In its statement, the SCJ reiterated that gambling in Chile is generally considered illegal unless explicitly authorized by law. Currently, only a limited number of entities are legally allowed to offer gambling services, including Polla Chilena de Beneficencia S.A., Lotería de Concepción S.A., certain racetracks, and casinos licensed under Law No. 19.995.

The SCJ also noted that a bill to regulate online gambling is currently under discussion in Congress. Until such legislation is enacted, any operation of online gambling platforms in Chile remains illegal.

The agency further warned that these unregulated platforms operate without paying taxes, offer no guarantees of fair play, lack fraud protection mechanisms, do not follow responsible gambling or child protection policies, and fail to comply with Chile's anti-money laundering and counter-terrorism financing regulations.

Finally, the SCJ urged the public not to engage with illegal online gambling sites, warning that users risk falling victim to fraud, such as withheld winnings or misleading promotional terms.
