Brazilian Court Temporarily Restores Betting Licence Despite Nationwide Ban

A Brazilian federal appeals court has granted CDA Gaming temporary relief from the nationwide betting prohibition, reopening a legal dispute over previously issued licences and the government's refusal to refund authorisation fees.

Brazil's nationwide betting ban faces a new legal challenge after the Regional Federal Court of the Third Region (TRF-3) temporarily restored the operating authorisation of CDA Gaming on November 3, 2026.

Federal appeals judge Adriana Pileggi granted interim relief to the company, which operates the Casa de Apostas, Betsul and Jogo Online brands. The decision suspends the effects of Provisional Measure No. 1,394/2026 specifically for CDA Gaming.

The company received its federal authorisation under Ministry of Finance Ordinance No. 255/2025, having paid R$30 million for a licence originally valid until December 31, 2029.

However, the provisional measure introduced in September 2026 required betting operators to cease activities within 30 days, terminating existing licences without providing reimbursement for unused periods.

The court's ruling also requires the restoration of the company's domains and access to operational, financial and payment services necessary for its authorised activities.

The decision remains temporary and applies exclusively to CDA Gaming. It does not invalidate Brazil's nationwide prohibition or automatically restore licences held by other companies.

The case follows public hearings at the Supreme Federal Court (STF) on November 3, where government representatives defended the ban while gambling associations and football organisations highlighted its economic consequences.

The ruling introduces a significant new development into Brazil's betting dispute. Further appeals and constitutional proceedings will determine whether this temporary exception survives and whether other previously licensed operators may obtain similar judicial protection.
