Brazil introduces new fees and advertising rules for regulated betting market

Brazil’s Secretariat of Prizes and Betting (SPA) has introduced two new normative instructions, clarifying administrative fees and advertising rules for the regulated betting market. The monthly supervision fee, mandated by Law No. 13,756/2018, will be calculated based on Gross Gaming Revenue (GGR) after deducting prizes and income tax, with payments due by the 10th of the following month via the PagTesouro system. The fee structure includes eight revenue brackets, ranging from BRL 54,419.56 ($9,400) for operators earning BRL 30 million ($5,180 ) to BRL 1,944,000 ($336,000) for those generating over BRL 660,960,000 ($114 million).

Additionally, the SPA has banned the use of national symbols, such as currency signs or images of banknotes, in advertising to prevent misleading claims about cash prizes. Non-compliance with these rules may result in fines, suspension of promotions, or revocation of authorization. The updates follow the launch of Brazil’s regulated online gambling market on January 1, which issued 71 operator licenses.

The SPA also clarified that licensed operators must pay a 12% tax on GGR, alongside contributions for COFINS, PIS, and ISS. These measures aim to ensure transparency, fair competition, and consumer protection in the growing betting industry.
